Proposed Amendments to the RPCs Would Address Artificial Intelligence
The Colorado Supreme Court is taking public comment on proposed amendments to the Colorado Rules of Professional Conduct that would explicitly address the impact of new technology, particularly artificial intelligence, on lawyers’ obligations in the practice of law. Specifically, the Court is proposing:
The Court has scheduled a public hearing for December 17, 2025, at 3:30 p.m. in the Supreme Court Courtroom. The deadline to request to speak at the public hearing is December 5, 2025, at 4 p.m. The deadline to submit written comments is December 1, 2025, at 4 p.m. Written public comments should be submitted in letter format addressed as follows: Colorado Supreme Court, 2 E. 14th Avenue, Denver, CO 80202. Public comments should be submitted by email in letter format as an attachment to the email as a Word or PDF document. Comments and speaking requests must be emailed to supremecourtrules@judicial.state.co.us. Written comments received by the deadline will be made public and posted to the website here after the comment period closes.
Reminders: Comment Deadlines Approaching on Proposed Changes to Rules Governing Licensed Legal Paraprofessionals (“LLPs”) and Attorney and LLP Discipline Procedural Rules
As summarized in OARC’s July 2025 newsletter, the Colorado Supreme Court has published for public comment two sets of rule proposals advanced by the Advisory Committee on the Practice of Law.
The first is a proposal from the LLP Committee to revise LLPs’ scope of practice and clarify or update a number of provisions in C.R.C.P. 207.1, 207.8 and 207.14. The deadline to submit comments is September 29, 2025, at 4 p.m. A public hearing is scheduled for October 21, 2025, at 3:30 p.m. The deadline to request to speak at the public hearing is October 10, 2025, at 4 p.m.
The second set of proposals pertains to the procedural rules that govern OARC, the Advisory Committee, the Legal Regulation Committee, the Presiding Disciplinary Judge and the Supreme Court in the realm of attorney and LLP discipline, at C.R.C.P. 241 et seq. The deadline to submit public comments is October 27, 2025, at 4 p.m. A public hearing has been scheduled for November 19, 2025, at 3:30 p.m. The deadline to request to speak at public hearing is November 6, 2025, at 4 p.m.

Judicial Department Explains Statutory Basis of CCE Certification and Next Steps
Attorneys may have briefly seen a new certification requirement in the Judicial Department’s Colorado Courts E-filing (CCE) system, which has now been removed. The certification requirement came directly from legislation passed earlier this year that applies to third parties (including certain attorneys, LLPs, and litigants) accessing certain nonpublic information maintained by the Judicial Department. The Department has taken down the certification prompt while continuing additional analyses and discussions. OARC Adopts Credit Card 2% Administrative Fee for Upcoming Attorney/LLP Registration
Pursuant to C.R.S. § 5-2-212, OARC will begin charging a 2% fee for the use of credit cards, including the upcoming attorney and LLP registration cycle that begins December 1, 2025. The 2% fee helps cover the cost of processing a credit or charge card transaction. OARC also will phase in the 2% fee for other credit card transactions, such as those charged for certain courses offered by OARC as well as applications for admission. Payments made by ACH transfer, check or debit card are not subject to the 2% fee.
OARC and certain other independent agencies, including the Office of the Presiding Disciplinary Judge, the Colorado Attorney Mentoring Program, and the Colorado Lawyer Assistance Program, are funded exclusively by fees and receive no taxpayer funding. Every time OARC collects a fee by credit card, generally over 2% of that fee must be paid to the financial institutions associated with that card and payment.
As we near the end of the year, OARC is preparing to send out registration statements. Be sure our office has your current contact information. To update your information, please submit your changes through the online change of address form (preferred), or you may notify the office in writing by sending a letter or email. The online registration system will be available at coloradolegalregulation.com starting on December 1, 2025. Postcard reminders will be mailed the last week of November.
Volunteer Openings for Board of Law Examiners Law Committee and CLJE Committee
Applications are being accepted for an opening on the Supreme Court’s Law Committee, as well as two additional seats for that Committee opening as of January 1, 2026. The Law Committee is the portion of the Board of Law Examiners that works with graders to facilitate the grading of the bar exam and makes policy recommendations to the Court pertaining to the exam, including the transition to the NextGen Uniform Bar Exam, and passing score recommendations. Pursuant to C.R.C.P. 202.3, committee members must be attorneys and are subject to appointment by the Colorado Supreme Court.
Applications also are being accepted for two seats on the Continuing Legal and Judicial Education (“CLJE”) Committee. The CLJE Committee reviews proposed administrative suspensions due to CLE non-compliance, participates in hearings relating to CLE non-compliance, and considers rule and regulation changes applicable to mandatory CLE in Colorado. Pursuant to C.R.C.P. 250.3, one of the two openings is designated for an attorney or LLP, and the other is designated for someone who is neither an attorney nor an LLP. Those seats will be open as of January 1, 2026.

IAALS Seeks Attorney Survey Participation in Foundations for Law PracticeThe Institute for the Advancement of the American Legal System (IAALS) is collaborating with the Law School Admission Council (LSAC) on Foundations 2.0, a major update of IAALS’ original Foundations for Practice project.Foundations 2.0 aims to survey thousands of practicing lawyers in every field of law and every geographic and demographic sector to identify the key skills needed in today’s legal profession. Foundations 2.0 will establish an evidence-based framework to unify educators, employers, and students around clear and consistent standards that will ensure students are as practice ready as possible upon graduation—and equipped to meet the ever-evolving needs of their clients. The survey can be accessed here and will be open through October 10. Please consider participating in this important project so the perspectives of Colorado’s legal profession will be represented.
